We Need a Bill Focused on Asbestos Victims

— Asbestos Disease is Nonpartisan...

We're in the midst of a lethal asbestos disease related epidemic... and this is no time for partisan politics.

In the next decade alone, it is estimated that 100,000 victims - 30 per day - will lose their lives as a result of asbestos exposure.

A Fair Asbestos Bill

Until now, the most important voice of all has not been heard - the voice of the victims. The Asbestos Disease Awareness Organization is changing that. We are the victims and their families, and here is what we believe are the key elements for a fair asbestos bill:

1. Independent Commission

  • ADAO calls for the establishment of an Independent Commission consisting of uncompromised medical and economic specialists - with direct input from asbestos victims - to determine and recommend appropriate victim compensation legislation

2. Sufficient Compensation

  • Victim compensation should take into account each person's varying "actual and punitive" damages
  • No debits against life insurance settlements or medical reimbursements
  • Must include calculation for loss of income and catastrophic medical expenses

3. Opt-out Clause

  • Ensures citizens their fundamental right to have their grievances heard in court

4. Ensures equitable compensation regardless of occupational, environmental or "take home" exposure

5. No time limit on filing for compensation

6. Bans the use of asbestos

7. Adequate funding to research effective treatment and a cure

8. Adequate funding to launch a National Asbestos Awareness Campaign

9. Cost-effective administrative procedures that promote efficiency and speedy processing of victim's claims

10. Settlement protection to honor pending cases and settlements
