ADAO Asbestos Trust Fund Legislation Summary:

Although we are not principally opposed to a trust fund, Americans deserve fair and equitable legislation for present and future victims. Before we pass legislation ending nearly all asbestos injury litigation, we need to assess and critique merits of the "Becker Discussion Draft"

Clearly, on January 11, 2005, the Judiciary Committee recognized the need to clarify areas of concern, such as:

  • Possible inaccurate data to forecast future victims
  • Possible inordinate delays processing 600,000 pending victims claim
  • Possible inability of the Deptartment of Labor to processing claims
  • Possible insufficient front-loading of fund

ADAO remains opposed to the discussion draft bill for the following reasons:

  • Incorrect, outdated and incomplete Medical Criteria.
  • Inordinate compensation delays and ineligibility for the victims.
  • Inadequate funding for not only compensation, but also research, education, prevention and outreach.
  • No opt out clause for the victim.

Watch the "Asbestos Kills(c)" Slideshow

"Asbestos Kills" slideshow features Warren Zevon's song "Keep Me in Your Heart".  Warren died from mesothelioma just weeks after the release of his Grammy-winning album "The Wind".  Many of the photographs in the slideshow are from photographer/producer Bill Ravanesi's award-winning exhibit, "Breath Taken."  Bill's father also died of mesothelioma.   Pete Mcphedran 's brilliant eye for design brought all mediums together.  “Asbestos Kills” was written and directed by Linda Reinstein.
