Asbestos Disease Awareness Organization Statement on Fifth Circuit Court of Appeals’ Denial of Its Motion to Reject the Alliance for Automotive Innovation’s Amicus Brief

“The Asbestos Disease Awareness Organization (ADAO) is disappointed that the Fifth Circuit Court of Appeals will allow the Alliance for Automotive Innovation’s (AAI) amicus brief to be considered. As both ADAO and the Environmental Protection Agency (EPA) emphasized, the AAI brief introduces new arguments outside the scope of the case. We will seek an opportunity to address these new issues as the case moves forward and will vigorously oppose the Alliance’s attack on the scientific basis for the EPA’s Part 1 chrysotile asbestos rule. ADAO and its 17 co-petitioners remain committed to protecting and strengthening the Part 1 rule.”
